Terms and Conditions
These Terms and Conditions ("Terms") apply to the café coffee consultation services offered by Taha Subhan ("I", "me", "my") and to the website where those services are offered (the "Website"). By submitting a consultation request, booking a consultation or using the Website, you ("you", "your") agree to these Terms. If you don't agree, please don't use the Website or the services.
1. The service
1.1 I offer consultations for people who are planning, opening, expanding or renovating a café, and for other businesses that serve coffee. A consultation can cover the café concept, the coffee menu, espresso machines, grinders, brewing equipment, water filtration, roaster selection and equipment sourcing options in Canada.
1.2 The initial consultation is free. There's no charge and no obligation to buy anything, now or later.
1.3 If you'd like more work beyond the free consultation, such as a detailed equipment plan, on-site visits or ongoing support, we'll agree on the scope, timing and fees in writing before any paid work starts. That written agreement will apply to the paid work in addition to these Terms. If the two conflict, the written agreement wins.
1.4 Submitting the consultation form is a request, not a booking. I review every request personally and I'll contact you to arrange a conversation. I may decline a request for any reason, for example if it's outside the services I offer.
2. Nature of my advice
2.1 My advice is based on my professional experience with coffee equipment and café operations. It's general guidance to help you make informed decisions. It isn't a guarantee of any result, including sales, customer volume, drink quality, equipment performance or business success.
2.2 I'm not a licensed engineer, plumber, electrician, architect, lawyer, accountant or financial advisor. Anything I say about plumbing, drainage, electrical requirements, ventilation, permits, building or health codes, leases, financing or taxes is general information only. Before you install equipment or make those decisions, confirm them with a licensed professional and your local authorities. Installation of commercial equipment should always be done by qualified technicians and must meet local codes.
2.3 Recommendations depend on the information you give me. If that information is incomplete or changes, my recommendations may no longer fit your situation.
2.4 You're responsible for your own business decisions, including what you buy, from whom, and at what price.
3. Equipment, brands and third parties
3.1 I don't manufacture equipment. Unless we agree otherwise in writing, I'm not the seller of any equipment I recommend. Any purchase you make is between you and the seller, under the seller's terms, pricing, delivery, return and warranty policies.
3.2 Warranties, service and support for equipment come from the manufacturer or seller, not from me.
3.3 Prices, availability, specifications and lead times change often and are set by manufacturers and sellers. Any figures I share are estimates, and I can't guarantee them.
3.4 Brand names and logos shown on the Website belong to their respective owners. They're shown to reflect my hands-on experience with those products. Showing them doesn't mean I'm an authorized dealer, distributor, representative or partner of any brand, or that any brand endorses me.
3.5 If I have a financial relationship with a seller or brand that I recommend to you, for example if I would earn a commission or be paid by the seller, I'll tell you before you buy.
4. Your responsibilities
You agree to:
- give me accurate and honest information about your project;
- use my advice only for your own café or business;
- not use the Website or the consultation form to send spam, false information, or anything unlawful or harmful.
5. Scheduling and cancellations
If you need to cancel or reschedule a consultation, please let me know as early as you can. For paid services, any cancellation terms will be set out in our written agreement.
6. Communications
6.1 When you submit the consultation form, you ask me to contact you about your request. I'll use your email address and phone number to reply and to follow up about your consultation.
6.2 I won't add you to a marketing or newsletter list unless you separately agree to it. You can ask me to stop contacting you at any time.
7. Intellectual property
7.1 The Website's content, design and text, and any materials I prepare for you, belong to me unless we agree otherwise in writing.
7.2 You may use materials I give you, such as notes, equipment lists or plans, for your own business. Please don't resell or publish them as your own without my permission.
8. Confidentiality
I'll treat the details of your café project as confidential and won't share them with anyone except as described in my Privacy Policy, as needed to help you (for example, when you ask me to contact a supplier for you), or as required by law.
9. Limitation of liability
9.1 To the maximum extent permitted by law, I'm not liable for any indirect, incidental, special or consequential loss, including lost profits, lost revenue, business interruption, or loss arising from equipment you buy from third parties, installation work, or decisions you make based on my advice.
9.2 To the maximum extent permitted by law, my total liability for any claim relating to the services or the Website is limited to the amount you paid me for the specific service the claim relates to. For the free consultation, that amount is zero.
9.3 Nothing in these Terms limits any liability that can't be limited under applicable law, including any rights you have under consumer protection laws.
10. The Website
10.1 The Website is provided "as is". I try to keep it accurate and available, but I don't guarantee that it will always be available or error-free.
10.2 The Website may link to other websites, such as manufacturer sites or social media. I'm not responsible for their content or policies.
11. Privacy
My Privacy Policy explains how I collect, use and protect your personal information. It forms part of these Terms.
12. Changes to these Terms
I may update these Terms from time to time. The updated version will be posted on the Website with a new effective date. Changes won't apply to paid work already agreed in writing unless we both agree.
13. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be dealt with by the courts of Ontario, unless the law of your province gives you the right to bring it where you live.
